Overview

At WebHostingM, we prioritize the protection of your intellectual property. If you find that your content is hosted on our services without your permission, our straightforward abuse reporting form is available for submitting a DMCA notification.


DMCA & WebHostingM

Section 512 of the DMCA details the statutory requirements for officially reporting copyright infringement and provides guidelines for submitting a counter-notice to appeal a removal.


If you suspect that material on WebHostingM websites or services infringes upon your copyright, please send a notice of copyright infringement containing the following information to our Designated Agent:


  • A physical or electronic signature of an individual authorized to act on behalf of the copyright owner whose rights are allegedly infringed.
  • Identification of the works or materials being infringed; this should include, at a minimum, the URL or IP address where the infringing material is located, along with a reference or link to the material or activity you claim is infringing, which you wish to have removed or disabled. Please provide sufficient information to allow us to locate the reference or link, including, at minimum, the URL or IP address where it can be found.
  • Contact details of the notifier, including address, telephone number, and, if available, an email address.
  • A statement of good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. Include this statement in the notice: "I hereby state that I have a good faith belief that the disputed use of the copyrighted material or reference or link to such material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
  • A statement made under penalty of perjury that the information provided is accurate and that the notifying party is authorized to file the complaint on behalf of the copyright owner. Include this statement in the notice: "I hereby state that the information in this notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."

Consequences of Sending A DMCA Notice

Upon receiving your notice, WebHostingM will assess its accuracy, validity, and completeness. If it meets these criteria, we will communicate the notice to the customer or user linked to the allegedly infringing material. The poster of the material may issue a counter-notice under Section 512(g)(3) of the DMCA if they believe the material is not infringing or they hold the right to use it.


Be advised that under 17 U.S.C. ยง 512(f), you may face liability for damages, including costs and attorney's fees, if you knowingly and materially misrepresent that material or activity is infringing. Before submitting a DMCA notice, confirm that you are the rightful copyright holder (or are authorized to act on behalf of the owner), that you genuinely believe the material you have identified is infringing, and that you understand the consequences of making a false claim.


Repeat Infringer Policy

In line with DMCA requirements, WebHostingM will terminate the accounts of subscribers who repeatedly infringe upon the copyrights of others, as deemed appropriate under the circumstances.
